Could she have a law suit?

my mom was ran over by a semi 2 years ago on september 30th 2008. she was driving an hhr and the semi driver ran a redlight and ran over the top of her car. almost every bone in her body was broke and she had a 5% chance of living. after she recovered 6 months later they had a law suit but the truck company threatened to file bankruptcy if she didn't accept their offer and went to trial then she wouldn't get anything. so she took their offer. but when she got ran over she was working for this courier service called KRUSE. well they didn't have her on a contract, just her husband. but they still let her drive for them and pick up their stuff. well my mom's mind was completely right when she went to settle and she decided not to sue the KRUSE company, even though she had a case then. Could she get a lawyer and go back & reopen that case against KRUSE?
